When I went to retrieve my car after it had been repossessed, the car would not start.  The repo yard employee took a great deal of time to recharge the car battery and told me the car was damaged.  I decided to just recharge the battery and thought that would be the end of it, but the car kept dying, or would not start.  I was stranded several times.  Eventually I replaced the battery although the battery in the car had been bought brand new only a few months prior.  Called CarMax and was instructed to send a copy of the receipt to receive reimbursement for the battery.  No answer for several months.  Called to inquire, and spoke to a CSR who kept insisting that I had been called several times with several voicemail messages left.  No such calls.  No such voicemail messages.  No letter of response.  No communication received from CarMax.  She left a message for another employee and told me I would receive a call.  When I returned the call the next day, all I got was a neverending voicemail request loop.  The CSR I spoke to was only interested in insisting that I had been called several times (no record of the "calls", no voicemails from those "calls") and kept demanding a "working" phone number from me when the first number never received any of their ghost calls!

CarMax agents damaged my perfectly working car during their repossession activity.  I should have received the car back in the same condition it was in when they took it.  I will never buy another car from CarMax.

Warranty...

Okay for the most part I am not going to go into the entire reposession aspect of this as it really doesn't matter for the rest.

As you see unless you can PROVE that they did something to damage your battery, there is really no standing you have that the recovery company or CarMax must reimburse you for a new Battery.  But since batteries will often just die, that is pretty much not going to happen.

However, if as you say you bought the battery just months prior, if you bought anything half-way decent it should have had at least a year(and hopefully a 3-5 year warranty) on it.  In that case, the replacement of the battery falls on the battery company, which you usually deal with where you originally purchased it.

For that you need to take the battery that died to the store with your receipt showing the date of purchase for the battery.  They would have then replaced it under that warranty.  Yes, this means you either need to remove the battery and take it to the store, or drive/tow it to the store so that they can remove it.  But once you go outside of this warranty procedure, you are NOT going to get reimbursed. 

If you bought a cheap piece of junk battery that was already out of warranty.  Then any replacement falls on you, and while you can try to get CarMax to reimburse you.  They aren't required to and you should consider anything out of them a bonus.

I will also just mention your last comment.  Generally when you have a reposession on your record from a company, they generally don't want you as a customer anymore either.  So while it probably is a very vindicating thought to think that you are the one who is walking away.  If you actually ever did try to get a car from them again, the chances of them approving you because of this repo would be very slim.

 YOU must be a mental ******!!1 ITS THIER VEHICLE!!!!!! It doesnt matter if THIER vehicle has been damaged, ITS THIER VEHICLE!!!! Lets not even go into the FACT that it was repoed!!! It means the vehicle was damaged due to YOU not paying your bill for FAR LONGER then just a simple being late. YOU were atleast 2-3 months behind in YOUR payments!!! SO suck it up buttercup, YOU CAUSED THE DAMAGES!!!! Maybe not directly, but due to YOUR INABILITY to pay what YOU OWE, the vehicle was repoed and damaged in the process. Had you paid the bill for the vehicle YOU wish to purchase then it wouldnt have been repoed. It wouldnt have been repoed and damaged. This whole issue could have been avoided had YOU paid your note ON TIME!!!! See the theme here?? YOU are blaming THEM for the situation YOU CAUSED!!!!
