OK I'm not writing to complain about the car because I understood what "sold as is" meant. Yes my car was a piece of garbage and not worth the $10,000 they were charging me.
My issue was with the pay ontime for 6 months and receive your downpayment back or visa credit card. Since my downpayment was $2000 I chose to have it returned to me. When the time came for them to pay up I was told that I wouldn't receive my money back until the car is 90% paid up.
Well the car never made it that far. My 3rd year of paying my note and numerous repairs the car finally died for good and I was told the costs of repairs would exceed the value of the car. So I decided it would be best to get another car instead. Since I only owed THE DUCK a little under $2000 on the car I figured they would just take that from the downpayment I was promised back, never happened.
To this day I still receive letters from the new company "drive time" requesting payment on the car. I'm debating on whether to pay the small sum off or just chuck it up as a loss since it's on my credit anyway. I was only 19 when I got the car (a first time buyer w/no credit) and they were the only ones to take me in. This was a learning experience.
Oh yeah I forgot to mention that I never received registration tags from THE DUCK for an entire year until I had to renew them the second year. They just kept giving me those paper tags month after month.

- You apparently didn't learn much. Why would you "think" they would just deduct the $2000 from your balance? Their is this little thing called COMMUNICATION that is COM-MU-NI-CA-TION. This is the process whereby you contact the company and explain the situation to find out what happens if you just stop paying on the loan.
Now, had you done this you would have found out that your thought was 100% WRONG. NO Company is going to just deduct some sort of rebate from any delinquent balance. In fact in many cases by you becoming delinquent you would have given up this refund by becoming delinquent.
You didn't say what the current status of the actual car is. You can't legally sell it since you don't hold the title. So you either still have the car just sitting there or you had it reposessed. Either way it is very unlikley that you still have a "small" balance. With late fees and other interest charges depending on how long this has been going on you may owe several hundred more dollars. Even if they reposessed it and sold it at auction, that amount was probably erased by additional repo and auction fees.
Since it doesn't seem to be with a collection agency, the best thing you can do right now is to actually contact them and see what your actual Payoff balance is and if possible see if you can give them a lump sum to just pay it off.
