Possession Never Transferred and they Have the Vehicle in their possession and my Money!!! DFW Airport TX

Gateway Classic Cars -Dallas is part of a National Operation of several locations all over the USA and they specialize in marketing and selling classic automobiles that are placed at their location on consignment by the actual car owners

This is where the scam begins because Gateway Classic Cars has no money to lose and/or at risk while they market the cars, they write the ad listings and they take the Photos and Videos while they take a position that they can't be held liable for any misrepresentations because they don't own the cars.

The consignors of the cars basically take the same position that they can't be held liable because they didn't place the ads, take the photos and videos and any misleading representation are that of Gateway Classic Cars so, consequently when you as a buyer buy a car from and through Gateway Classic Cars at any of their locations, you have no body to hold liable the way they operate this operation.

During the first week of July 2021, I began sending emails to Gateway Classic Cars-Dallas c/o Steve West who is listed as a Sales Leader at the Dallas TX location and based on the Photos and the lsiting which described a pampered and babied low milaege Classic 2007 Mustang Shelby GT-500 and after speaking with Mr. West I made an offer of $32,500 out the door plus T.T.&L and he accepted the offer.  I also requested a copy of the car fax on the car which he sent and it shows NO ACCIDENTS reported and its a garage kept, Non Smokers car so I figured it was a primo, grade #1 Mustang Shelby GT-500 that needed nothing!

Mr. West requested that I give him a credit card deposit for $1,000 and I told him I would however not as a Non Refundable deposit in case something would go wrong with the deal on their end and he agreed.

The total price including T.T.&L was to be $34,734.07 and I made arrangements for the balance in full to be sent via ACH on Monday 07/19/2021 through my credit union.

In the  meantime, Steve West agreed to send me all the hard final prepared documents to me for my review and execution so I would have a copy of the originals and so would they.  These were received Saturday 07/17/2021 before the ACH was to occur so, I could review and change my mind if something needed changed or corrected.

During this same weekend, I noticed something very disturbing on the only photo showing the rear of the car which showed the Shelby GT striping completely missing from the lower rear valance of the car.

I sent Steve West a text and email first thing Monday morning 07/19/2021 stating that we have an issue because there was Shelby GT striping missing on the car so, the fact the car fax I relied upon stating NO ACCIDENTS now is highly in question because striping just doesn't fall off of a car.

Mr. West acted confused and concerned too and said he would get right on top of it and contact the consignor (car owner) to see what he says.

Keep in mind that this is the same day the ACH was set to hit Gateway Classic Cars account and out of my account so I wanted this issue resolved to my satsifaction or I would cancel the deal.

The day went by and it wasn't until the day was over that Steve West sent me a text saying the consignor says the car was like that when he bought it 2 years earlier and it must've just fallen off or came off at the car wash or something?  Hogwash is what I said!!!

A car that has supposedly been babied and pampered and garage kept usually gets hand washed and hand waxed and doesn't go to car washes.

I told Steve West that I didn't buy a Mustang Shelby GT 500 where some of the striping is missing and I now question if this car was in a wreck and had the rear valance replaced and they just never replaced the striping because you have to buy the whole stripe kit for the whole car and not just part of the kit.

I never heard anymore from Steve West until this morning, 07/22/2021 when he sent an email to me now that all my funds have cleared their account and I am out the money and they still have the car and he stated that neither he, Gateway Classic Cars or the consignor were going to do anything and I bought the car AS-IS and the deal was now final and I have NO RECOURSE.

The Steve West had someone named Anthony Freeman send me a few emails from the St Louis Mo. offices telling me basically the same thing that the deal is Final and I bought it AS-IS and that I have NO RECOURSE!.

I learned later in the day that a Shawn Beach who is CFO and COO for Corporate has an email so I advised him as well what was going on and how I've been treated on this matter.  He never responded!

I've also advised all three people involved with this transaction that I was recinding the deal and that I haven't accpted possession nor will I accept possession and I made d deamnd that the full amount of $34,734.07 be wired back to my account and I provided them with my Routing and My Account Number and demanded it be back in my account by the end of today at close of business.

Reasons to Recind the deal include:   False and misleading advertising in order to deceive into the transaction, Deceptive Fair Trade, Fraud and many other deceptive practices as well as serious questions about the CarFax showing NO ACCIDENTS because Shelby GT Striping doesn't just fall off the car???

Additionally, I have now discovered there are (18) other complaints right here on Ripoff Reports against various locations of Gateway Classic Cars as well as complaints and negative reviews all over the internet about this company both from Consignors who got cheated to innocent buyers such as myself who believed this was a legitimate company and not a license to steal in the way they conduct their business.

Do yourself a favor and do your research on this Organization and check them out by all the negative reviews all over the internet, here on Ripoff Reports, Better Business Bureaus etc etc.

my advice is Hold on to your money and steer clear from this entire organization.

As stated in the complaint, striping doesn't simply fall off of a car?  This transaction was never completed before the deal was "Rescinded" therefore, possession never transferred, the title remains in the name of the consignor and owner of the vehicle in question and the car remains consigned to the Dealer.  The Dealer "MUST" return the entire amount IMMEDIATELY to avoid litigation.

The key word is 'reported.' A Carfax is only as accurate as incidents reported to Carfax, Inc. You are assuming the vehicle has been in an accident. You could be wrong.

As per your narrative, nothing went wrong on their end.

"Recind" is not a word. Rescind is a word.

Pictures of the vehicle were made available to you; therefore, your claim of false advertising and deception are false allegations. Your claim of fraud is also a false allegation unless you can prove the dealer was aware of and attempted to conceal a prior accident. Your entire claim is based on speculation.

Apparently, you are confused by the term AS-IS. You refuse to accept the vehicle so it's only a matter of time before the vehicle is considered abandoned. Hey, it's only $34K.

You are suffering from a case of buyer's remorse. Happy motoring!
