To whom this May concern:

This is a dispute with America Home Shield They refuse to honor their contract to fix my HVAC Properly.

  1. I called them to tell them that my HVAC wasn't working properly. They sent out a contractor out.

  2. I was told that because my unit was in the closet it was to hard for them to get to the repairs so they wanted to charge me 2200 dollars. (not paid by company so they say)

  3. I said no way so then they tried to tell me that my unit needed modifications that the company didn't pay for per the contract it states it will cover upgrades which also means up to code.

    when I called the company to complain they said they would offer me a upgrade for 2200. I have attached a copy of the contract stating that upgrades are covered. So they are throwing around the word modification to give the contracting company more money and rip me off.

  4. Attached is all the parts and repairs covered which is most of what need to be done, I told them I want a different company to do the job that doesn't charge extra to do the job they are already paid to do. I asked for another opinion from another contrcter within their company

  5. The cash out amount was only around 500 which was a joke. It was far more than that to repair my 23 yr old unit.

  6. I called on 5/6 and asked repeatedly for escalations and a second opinion and they have ignored me thus far.

I have attached all documents to prove they are trying to get out of their responsibilities

 The way all home warranties work is that they pay the contractor almost nothing beyond the deductible and expect them to either find ways to deny your claim or to charge you for their labor. With HVAC and water heaters, they will first try their generic denials (rust, lack of maintenance, preexisting conditions). If they do somehow agree to replace the unit, they basically just pay for a cheap builder grade unit and nothing else. The contractor has to charge you bogus "modification" fees to not lose money on the job. And these contracts completely exclude "modifications" and "code upgrades" while not defining what constitutes them. Therefore, they are free to interpret them as basically anything pertaining to installation. And since you won't be suing them in court, they can get away with it (note the arbitration clause in the contract). The other problem is that their installers are invariably terrible. No reputable HVAC company would agree to do an install for these clowns. So you will end up with a shoddy installation and very short equipment lifespan. Cancel the pointless home warranty and just put the money in a savings account. You will come out far ahead over time. And this is not specific to AHS. All home warranties work this way.
